Top margin should be ~7-8 pixels smaller,
I made SS of system listpicker (ringtone selector) and Teleriks one.
Top red line near system tray shows that emulators are aligned correctly.

When developing the ListPicker, our designers have been relying on design guidelines sent from Microsoft and we've made sure the ListPicker is compliant with those guidelines.
In your scenario, you can easily increase the margin of the header by setting the PopupHeader property.
